The following terms and conditions must be read and agreed to by ticket buyers in order to purchase a ticket on the The Ticket Store service. By clicking the, "I have read and agree to the terms and conditions" check box, required upon ticket purchase, You, the ticket buyer, acknowledge that you have carefully read and fully understand the content of the following terms set forth by individual event organizers and The Ticket Store, and that you agree to their conditions.
The Ticket Store is referred to by name or “We”. When this Privacy Policy uses the term “Organizer”, we mean event organizers using The Ticket Store to create events for ticket buyers or ticket registrants. Ticket Buyers and third parties using The Ticket Store to either purchase a ticket for an event or register for an event are all referred to in these Terms collectively as “Buyers”, “Buyer”, “You”, or “Your”. organizers and Buyers are collectively referred to as “User” and “Users”.
From all Users, we may collect personal data, which is voluntarily provided in order to use The Ticket Store for inquiring on, listing, producing, registering, transferring, or buying tickets related to events listed in The Ticket Store. We may also receive personal data from third party sources, such as other Users, social media, our payment processing partners, or other third parties. The personal data collected may include without limitation names, email addresses, phone numbers, physical addresses, or any other information that Users or third party sources choose to provide, which may cause Users to be personally identified. In addition, organizers can set up event registration pages to collect virtually any information that the Buyer may choose to provide. The Ticket Store does not control the personal data that organizers may collect from Buyers. Additionally, The Ticket Store may collect personal data from Buyers on behalf of a Organizer. When You register for an event with, or otherwise provide information to, The Ticket Store in conjunction with an event or activity, whether that information is Yours or a third party’s, in connection with a purchase, registration, or transfer, The Ticket Store and the Organizer will receive and may use the information provided.
The Ticket Store does not store identifying credit card numbers. Identifying credit card information is stored with our payment processing partners, for example Stripe and Authorize.Net. In order to buy a ticket on The Ticket Store, Buyers will need to provide financial information (e.g. credit card numbers and expiration dates, billing addresses), some of which may constitute personal data.
We collect and use personal data in a manner that is consistent with this Privacy Policy and applicable privacy laws. We may use the personal data as follows: If You provide personal data for a certain purpose, we may use the personal data in connection with the purpose for which it was provided. For instance, if You contact us by email, we will use the personal data You provide to answer Your question or resolve Your problem and will respond to the email address from which the contact came. Additionally, if You registered, signed up for, added Yourself to a list, or made a purchase for an event on The Ticket Store, Your email address is available to the relevant Organizer and The Ticket Store.
The Ticket Store will not sell Your personal data. We consider this information to be a vital part of our relationship with all Users. Therefore, we will not sell personal data to third parties, including third party advertisers. There are certain circumstances in which we may disclose, transfer, or share personal data between Buyers and organizers without further notice, as set forth in this Privacy Policy.
When a Buyer registers for an event, signs up for communications, adds themselves to a list, or otherwise inputs personal data (such as through a web form) to communicate with a Organizer or The Ticket Store in order to participate in an event, the Organizer and The Ticket Store will receive and may use that information. The Organizer may send marketing or other communications, which may be subject to its own separate privacy policy. Likewise, if a Buyer provides a phone number, then messages related to the service, event, activity, or information in which the Buyer expressed an interest, may be sent by the Organizer and The Ticket Store.
The Ticket Store may store personal data, and such information may be stored by third parties to whom we have transferred it in accordance with this Privacy Policy. We take what we believe to be reasonable steps to protect the personal data collected via The Ticket Store from loss, misuse, unauthorized use, access, inadvertent disclosure, alteration, and destruction. However, no network, server, database, or Internet or email transmission is ever fully secure or error free. Therefore, Users should take special care in deciding what information is sent electronically. Please keep this in mind when disclosing any personal data. We retain Your personal data for as long as necessary, and may retain Your personal data indefinitely, to provide You with our services, to provide Event organizers with past order information as needed, or for other important purposes such as complying with legal obligations, resolving disputes, and enforcing our agreements.
The Buyer will receive a refund for a ticket cancellation based on the cancellation policy that was set at the time of ticket purchase. The Ticket Store service fees will be retained when an order is refunded, unless the event is cancelled or if the Buyer was charged multiple times in error.
In the case of a cancelled event, organizers may work with Buyers to either credit their ticket purchase toward a future event or refund their ticket purchase. For refunded ticket purchases, processing fees will be retained by the credit card processing company. The Ticket Store will refund its service fees to the Buyer.
You understand and agree that some events may carry inherent risk, and by participating in those events, You choose to assume those risks voluntarily. For example, some events may carry risk of illness, bodily injury, disability, or death, and You freely and willfully assume those risks by choosing to participate in those events.
You agree that to the extent permitted by applicable laws, the services offered by The Ticket Store are provided on an “as is” and “as available” basis. The Ticket Store expressly disclaims all warranties of any kind, expressed or implied, including, but not limited to, implied warranties of merchantability, title, non-infringement, and fitness for a particular purpose.
You acknowledge that The Ticket Store has no control over the quality, safety, accuracy, or legality of any content associated with an event, and does not guarantee the truth or accuracy of any information provided by organizers. The Ticket Store has no responsibility to You for, and hereby disclaims all liability arising from, the acts or omissions of any Organizer or any third parties that The Ticket Store requires to provide services, that a Organizer chooses to assist with an event, or that You choose to contract with when using The Ticket Store.
You hereby agree to release The Ticket Store from all damages (whether direct, indirect, incidental, consequential, or otherwise), losses, liabilities, costs, and expenses of every kind and nature, known and unknown, arising out of a dispute between You and an Event Organizer, or You and The Ticket Store, or You and a third party in connection with The Ticket Store. In addition, You waive any applicable law or statute, which says, in substance: “A GENERAL RELEASE DOES NOT EXTEND TO CLAIMS WHICH THE RELEASING PARTY DOES NOT KNOW OR SUSPECT TO EXIST IN HIS FAVOR AT THE TIME OF EXECUTING THE RELEASE, WHICH IF KNOWN BY HIM MUST HAVE MATERIALLY AFFECTED HIS SETTLEMENT WITH THE RELEASED PARTY.”
You agree to defend, indemnify, and hold The Ticket Store, and its affiliates, and, as applicable, each of its respective agents, licensors, payment processing partners, and other partners, harmless from any and all damage (whether direct, indirect, incidental, consequential, or otherwise), injury, loss, liability, cost, and expense (including, without limitation, reasonable attorneys’ and accounting fees) resulting from any claim, demand, suit, proceeding (whether before an arbitrator, court, mediator, or otherwise), or investigation made by any third party due to or arising out of (a) Your improper use of The Ticket Store services, (b) Your breach of any applicable local, state, provincial, national, or other law, rule or regulation, or the rights of any third party, (c) any incidents occurring at an event listed with The Ticket Store, or that The Ticket Store was providing services with respect to those events. This indemnification shall not apply to the extent that a claim arises out of The Ticket Store’ gross negligence or willful misconduct.
You agree that to the extent permitted by applicable laws, or as otherwise set forth herein, The Ticket Store, and any person or entity associated with The Ticket Store, will not be liable to You or any third party, for any indirect, incidental, special, consequential, punitive, or exemplary damages, including, but not limited to, damages for loss of profits, goodwill, use, data, opportunity costs, intangible losses, or the cost of substitute services (even if The Ticket Store has been advised of the possibility of such damages), or Your content. Nothing in these Terms is intended to exclude or limit any condition, warranty, right, or liability which may not be lawfully excluded or limited.
